California and Colorado Residents: The APEC Water Rewards Program may be considered a “financial incentive” under California law or a “Bona Fide Loyalty Program” under Colorado law. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE APEC WATER REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE, INCLUDING OUR WEBSITE TERMS AND CONDITIONS AND PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT PARTICIPATE IN THE APEC WATER REWARDS PROGRAM.

The APEC Water Rewards Program (“Rewards Program” or the “Program”) is operated by APEC Water Systems (“APEC Water,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) apply to your access to and participation in the Rewards Program. These Terms are subject to, and do not alter in any way, APEC Water’s Terms and Conditions (also referred to as Terms of Use) and Privacy Policy. Please review the Privacy Policy carefully to understand how APEC Water collects and uses personal information. In the event of any conflict between these Terms and the APEC Water Terms and Conditions, the Terms and Conditions will control.

By joining the Rewards Program, you agree that disputes between you and APEC Water will be resolved according to the dispute resolution procedures outlined in the APEC Water Terms and Conditions, which may include binding arbitration and waivers of class actions or jury trials. PLEASE READ THE TERMS AND CONDITIONS CAREFULLY.

All Rewards Program benefits, points, rewards, and statuses are subject to availability and may be changed by APEC Water at any time without notice. APEC Water may terminate the Rewards Program, in whole or in part, at APEC Water’s sole discretion. APEC Water may also choose to substitute a similar loyalty program at any time. If the Rewards Program is terminated, all unredeemed points will be forfeited without any obligation or liability.

These Terms supersede all previous terms and conditions applicable to the Rewards Program or similar APEC Water loyalty initiatives. Except as otherwise expressly prohibited or limited by applicable laws, APEC Water may at any time amend, modify or supplement these Terms, the structure for earning rewards, points, or tier status at any time, with or without notice, even though such changes may affect the value of accumulated points or the ability to obtain certain benefits. You are responsible for remaining knowledgeable of the Terms and any changes. Your continued participation in the Rewards Program will constitute your acceptance of any such changes to these Terms or the Rewards Program. If you object to these Terms or any changes hereto or at any time become dissatisfied with the Rewards Program, your sole recourse shall be to opt-out of the Rewards Program. APEC Water shall not be liable to you in any way for any value or benefits you may lose as a result of any changes made to the Rewards Program, including, without limitation, any points or rewards.

1. Program Eligibility and Membership

The Rewards Program is a loyalty program offered to APEC Water account holders. To be eligible for participation in the Program, you must be a legal resident of the fifty (50) United States or District of Columbia and at least eighteen (18) years of age or older. The Program is available only to individuals for their personal use and is limited to one (1) account per individual. Employees of APEC Water and its subsidiaries, affiliates, and divisions are eligible to participate in the Program only for personal use. The Program is void where prohibited or restricted by law.

By joining the Program and becoming a Rewards Program member, you agree that you have read, understood, and agree to be bound by these Terms and by any changes or modifications that we may make hereto, as well as all other terms of use and policies incorporated by reference.  

2. Program Enrollment

Eligible individuals may enroll in the Program online by visiting www.apecwater.com (the "Site"). To enroll online, visit the Site and follow the Program prompts to register for an account or log into your existing account and opt-in to the Rewards Program if required. It is free to sign up for an APEC Water account and to enroll in the Rewards Program. There is no purchase, payment, or credit card required to sign up for, join, and/or participate in the Program.

To enroll in the Program, you may be required to provide your first and last name, valid email address, and potentially other information. You are solely responsible for maintaining the accuracy of your account information and for keeping it up to date. You may update your personal information through your online account or by contacting customer service.

Only one Program account may be associated with a single email address. In the event of a dispute over the ownership of a Program account membership, the Program member will be deemed to be the authorized account holder of the email address submitted at the time of Program enrollment.

You may opt out of the Rewards Program at any time by contacting customer service or managing your preferences within your account profile on the Site (if available). If you elect to opt-out or cancel your APEC Water account, you (i) will not be able to redeem any unused Rewards Program rewards or points, (ii) may not be able to retrieve previously-earned points or rewards if you elect to join again later, and (iii) will not be able to earn points for purchases or actions taken while not enrolled in the Rewards Program.

Enrollment and participation in the Program are voluntary, optional, and not required to complete any transaction or sale.

3. How the Program Works / Earning and Redeeming Points

3.1. Earning Points: The Program allows you to earn points towards redeeming rewards based on making qualifying purchases.
* Qualifying Purchases: Purchases made online at www.apecwater.com are eligible for earning points, excluding taxes, shipping and handling charges, gift card purchases, and any other fees or charges specified by us from time-to-time (a “Qualifying Purchase”).
* Earning Rate: Members earn points for every dollar spent on Qualifying Purchases (rounded down to the nearest whole dollar). The number of points earned per dollar depends on your member status:
* General Members: Earn 10 points for every $1 spent.
* Gold Members: Earn 15 points for every $1 spent.
* Platinum Members: Earn 20 points for every $1 spent.
* (Note: The criteria for achieving Gold or Platinum status may be outlined separately on the Rewards Program information page or within your account dashboard.)
* Online Purchases: To earn Program points for a Qualifying Purchase made online, you must be logged into your APEC Water account at the time of purchase. Points cannot be earned retroactively for orders completed before logging in or enrolling. Program points earned for online Qualifying Purchases will typically be allocated to your account after the order is processed or shipped. Please allow a reasonable time for points to appear in your account.
* Returns: If you return an item from a Qualifying Purchase for a refund to your original method of payment, the points earned for that item will be deducted from your Program account.

3.2. Redeeming Points: You can redeem your accumulated points for dollar-off discounts on future purchases on the Site.
* Redemption Rate: 500 points = $1.00 discount.
* Available Rewards: Points can be redeemed for the following discount amounts (subject to change):
* $5 off (2,500 points)
* $10 off (5,000 points)
* $15 off (7,500 points)
* $25 off (12,500 points)
* $50 off (25,000 points)
* $75 off (37,500 points)
* $100 off (50,000 points)
* $150 off (75,000 points)
* $200 off (100,000 points)
* How to Redeem: To redeem points, log into your account, navigate to the Rewards Program section, click "Redeem my points," and select an available reward coupon. The coupon can then be applied during the checkout process. Rewards must be redeemed at the time of purchase and generally cannot be applied retroactively.

3.3. Point Value and Transferability: Program points and rewards earned through the Program have no cash value, cannot be sold, are non-transferable, and you have no property rights in or to points, rewards, or other Program benefits. Program accounts, points, or rewards cannot be transferred to, shared, or combined with any other person or Program member. Only the Program member may accumulate and redeem points and rewards associated with their account. The sale, barter, transfer, or assignment of any reward or benefit offered through the Program, other than by us, is expressly prohibited.

3.4. Program Modifications and Limitations: Rewards available through the Program are for personal use only. We reserve the right, without notice, to cancel, modify, or restrict the Program, including the points structure, rewards, and benefits at any time, in our sole discretion. We reserve the right to place limitations on the number of Qualifying Purchases eligible for points and/or the number or types of rewards you may receive or earn.

3.5 Account Status and Expiration: Your member status, accumulated points, and available rewards may be subject to expiration or reset based on program activity or specific timelines outlined on the Program information page, FAQs, or within your account. Please refer to the Program details for current policies regarding point and reward expiration.

3.6. Account Disputes: We reserve the right to determine the points and rewards in any member's account based upon our internal records. Our good faith determination of the amount of points/rewards available shall be final and binding. If you have concerns regarding your account activity, please contact customer service.

4. Communications

4.1. Email Communications: By enrolling in the Program, you may be automatically subscribed to receive marketing emails from APEC Water, including Program-related communications. You may opt out of receiving marketing emails from APEC Water at any time by clicking the “unsubscribe” link in the email or as otherwise provided in the APEC Water Privacy Policy. You may choose to receive only Program-related communications (e.g., emails relating to your account, rewards, or service-related updates) by managing your preferences if such an option is available.

4.2. Text Message Communications (SMS): If you consent to APEC Water’s SMS/text messaging service, you agree to receive recurring SMS/text messages as outlined in the Mobile Terms section below and/or our main Terms and Conditions.
* Mobile Terms: Your use of the SMS Service constitutes your agreement to the applicable Mobile Terms. We may modify or cancel the Service or any of its features without notice. We may also modify Mobile Terms at any time.
* Consent: By consenting, you agree to receive recurring automated promotional and personalized marketing text messages (e.g. cart reminders) from APEC Water at the cell number used when signing up. Consent is not a condition of any purchase.
* Opt-Out: Text the single keyword command STOP to the specific number provided in the SMS messages (e.g., +18334671664) or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message.
* Help: For Service support or assistance, text HELP to the number provided or email info@apecwater.com.
* Carrier Liability & Charges: Message and data rates may apply. Message frequency varies. Wireless carriers are not liable for delayed or undelivered messages. You are responsible for all charges associated with text messaging imposed by your wireless provider.
* Your Information: You agree to provide us with a valid mobile number and notify us of any changes. You agree to indemnify us for claims resulting from your failure to notify us of a change in your number or from providing a number for which you are not the user.

5. Privacy

The personal information that we collect from you in connection with the Program is subject to our Privacy Policy. Your information will be used and disclosed by us for the purpose of administering the Program, providing you with rewards or benefits, marketing in connection with the Program, other marketing communications you have opted into, and as otherwise permitted by our Privacy Policy. As noted above, California and Colorado residents should refer to our Privacy Policy for specific disclosures regarding Financial Incentives / Bona Fide Loyalty Programs under CCPA/CPA.

6. Program Termination, Cancellation or Modification

The Program and its benefits are offered at APEC Water's sole discretion. We may terminate, cancel, modify, or restrict these Terms and/or the Program or any aspect of it at any time, with or without prior notice, even if such actions affect the value of points or rewards already accumulated.

If you decide you no longer want to participate in the Program, you may cancel your membership at any time by contacting customer service. Any accrued points and/or unused rewards will typically be forfeited and expire immediately upon cancellation.  

We reserve the right, in our sole discretion, to terminate any member from the Program for any reason, including failure to comply with these Terms, the APEC Water Terms and Conditions, suspected abuse of the Program, illegal activity, fraud, or other conduct inconsistent with these Terms or the Program's intent.

If your membership is canceled or terminated, all unused rewards and points will be forfeited immediately.

7. Disclaimer of Warranties; Limitation of Liability

YOUR PARTICIPATION IN THE PROGRAM IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PROGRAM AND ANY REWARDS OR BENEFITS ASSOCIATED THEREWITH ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY WHATSOEVER. APEC WATER AND ITS AFFILIATES, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE TERMS, THE PROGRAM, AND ANY REWARDS OR BENEFITS, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, APEC WATER AND ITS AFFILIATES, PARTNERS, AND LICENSORS WILL NOT BE RESPONSIBLE OR LIABLE (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) UNDER ANY CIRCUMSTANCES FOR ANY: (A) INTERRUPTION OF BUSINESS; (B) ACCESS DELAYS OR INTERRUPTIONS TO THE PROGRAM; (C) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (D) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD-PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (E) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD-PARTY WEBSITES; (F) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (G) EVENTS BEYOND OUR REASONABLE CONTROL.  

FURTHER, TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER APEC WATER NOR ITS AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) RELATED TO THE PROGRAM OR YOUR PARTICIPATION, REGARDLESS OF THE FORM OF ACTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).  

YOU AGREE THAT NO CLAIMS OR ACTION ARISING OUT OF, OR RELATED TO, YOUR PARTICIPATION IN THE PROGRAM OR THESE TERMS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION RELATING TO SUCH CLAIM OR ACTION AROSE. IF YOU ARE DISSATISFIED WITH THE PROGRAM, TERMINATION OF YOUR MEMBERSHIP IS YOUR SOLE REMEDY.

8. Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS APEC WATER, ITS SUBSIDIARIES, AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS' FEES), ARISING FROM OR IN CONNECTION WITH (i) YOUR PARTICIPATION IN THE PROGRAM, (ii) YOUR REDEMPTION OR USE OF ANY POINTS, REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM, AND/OR (iii) YOUR BREACH OF ANY OF THESE TERMS OR APPLICABLE LAW.  

9. Governing Law

The Program and these Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of law provisions. Any dispute relating in any way to the Program or these Terms will be resolved in accordance with the dispute resolution provisions in the APEC Water Terms and Conditions.
